Position Summary:

This position attends to the legal needs of the Fall Creek global group as it conducts business in Europe, the Middle East, and Africa (“EMEA”).  The position is housed in Fall Creek’s European head offices located in Aznalcazar, Spain and is responsible for a wide array of legal issues throughout the EMEA territory. EMEA Counsel reports to and must maintain clear lines of communication and accountability with Fall Creek’s General Counsel, located in the US Legal office. This position requires a high degree of independent professional judgment in problem-solving, researching solutions, and decision-making. Substantial travel required throughout EMEA and occasional travel in other regions in which Fall Creek operates. 

Essential Duties:

  • Assist the Fall Creek global group in all aspect of their legal affairs arising in EMEA, including commercial operations, import/export requirements, protection of intellectual property rights, the administration of royalties and other reporting requirements, labor and employment issues, and the compliance with corporate requirements, including entity formation, annual compliance, matters of public registry, matters, managing powers of attorney and other corporate matters.

  • Conduct due diligence for expansion of business into new territories (e.g. tax issues, business structures, IP and regulatory environment, effectiveness of PBR, etc.) and potential new licensing partners.

  • Support US IP and Licensing Counsel in the protection of Fall Creek’s Intellectual Property rights and in the administration of Fall Creek’s licensing platforms (e.g. compliance, enforcement, reporting).

  • Lead Fall Creek’s local acquisitions, dispute resolution, and administrative compliance.

  • Provide needed legal input to support Fall Creek’s European blueberry breeding efforts by assisting with technical paperwork, DUS test coordination, and other tasks necessary to register and protect our plant varieties.

Required Education, Knowledge, Skills and Training:

  • Requires a law degree and license to practice law in Spain.

  • Bilingual oral and written fluency in Spanish & English.

  • 10+ years’ experience in the practice of law in a position that includes drafting of legal documents and contract negotiations; international experience is strongly preferred.

  • Extensive knowledge of business law and a strong working knowledge of intellectual property law.
